Rules for Buying Carpets from MirzapurLooms

These terms explain the legal agreement between you and MirzapurLooms when you purchase carpets or book workshop services. Please read carefully before placing an order.

Governing law: These terms are governed by the laws of India. All disputes are subject to the exclusive jurisdiction of courts in Mirzapur, Uttar Pradesh.
Business licenses: We hold valid trade licenses issued by Mirzapur Municipal Corporation, GST registration, and export license from Ministry of Commerce, Government of India.
How Orders Work: From Inquiry to Delivery
Step 1 - Initial inquiry: When you submit a form or email us, it's not an order yet. It's a request for information.
Step 2 - Our quote: We send you photos, specifications, and pricing. This quote is valid for 30 days.
Step 3 - Your confirmation: To place an order, you must send written confirmation via email and pay the deposit (see payment terms below).
Step 4 - Our acceptance: We send an official order confirmation with:

Estimated production time (for custom carpets) or shipping date (for ready-made)

Payment schedule
Legal binding: The order becomes legally binding when we send this confirmation email. Before that point, either party can cancel without penalty.
Payment Terms You Need to Know
For ready-made carpets (in stock):

40% deposit required to reserve the carpet

60% due before shipping

We hold your reserved carpet for 14 days after deposit. After that, if full payment isn't received, we may sell it to another customer (deposit refunded minus 10% handling fee)
For custom-commissioned carpets:

50% deposit to start production

25% at halfway point (we send progress photos)

25% upon completion before shipping
Accepted payment methods:

Bank transfer (NEFT/RTGS) - preferred for Indian customers

International wire transfer (SWIFT)

Credit/debit card via Razorpay (3% processing fee applies)

PayPal for international orders (4% processing fee applies)
Currency: All prices quoted in Indian Rupees (₹). International customers are responsible for currency conversion and bank charges.
Price guarantees: Price is locked when you pay deposit. Even if material costs increase during production, your price won't change.
Production Timelines and What Can Delay Them
Typical timelines:

Simple modifications to existing designs: 3-4 months

Medium complexity custom designs: 5-6 months

High complexity silk carpets: 7-8 months

Large carpets over 12x15 ft: Add 2 months to above timelines
These are estimates, not guarantees. Delays can happen due to:

Material availability (especially rare natural dyes)

Weaver illness or emergency

Design revisions you request mid-production
-
Quality issues requiring sections to be re-woven

Natural disasters, government restrictions, or other force majeure events
If delays occur: We notify you immediately and provide updated timeline. For delays beyond 60 days from original estimate, you can cancel and receive full refund of all payments made.
Rushing orders: We can expedite production for 25% premium, but minimum timeline is still 2 months for simple designs.
Your Responsibilities as a Customer
Providing accurate information: You must give us correct measurements, color preferences, and delivery address. Errors on your part may result in additional charges for modifications.
Design approvals: For custom carpets, you must approve the design proposal within 14 days. Production can't start until you give written approval.
Responding to progress updates: When we send progress photos, please review within 7 days. Silence is considered approval to continue.
Making payments on time: If payment deadlines are missed by more than 30 days, we reserve the right to cancel the order and sell the carpet to another customer.
Accepting delivery: You (or someone you authorize) must be available to accept delivery. If delivery fails due to your unavailability after 3 attempts, storage fees of ₹500/day apply.
Inspection upon delivery: You have 48 hours to inspect the carpet and report any damage. After that, we assume it was received in good condition.
Returns, Refunds, and What's Not Refundable
Ready-made carpets:

Full refund issued within 7 business days of receiving returned carpet
Custom-commissioned carpets:

NO returns or refunds once production starts (after you approved the design)

Exception: Manufacturing defects - we'll repair or replace at no cost

Exception: Significant deviation from approved design - we'll remake or refund
What's never refundable:

Design fees (₹25,000 for original designs)

Workshop tour or masterclass fees (unless cancelled 48+ hours in advance)
Cancellation before production starts:

Full refund minus 10% administrative fee

Shipping: Who Pays, Who's Responsible
Domestic India shipping:

Free for orders above ₹50,000

₹2,500 flat fee for orders below ₹50,000

Delivery via Blue Dart or FedEx, typically 5-7 business days
International shipping:

Calculated based on destination and carpet size

We use DHL or FedEx with full tracking

Typical delivery time: 7-14 days

Shipping quote provided before final payment
Insurance: All shipments are insured for full carpet value at no additional cost to you.
Customs and duties: For international orders, you are responsible for all customs duties, import taxes, and clearance fees in your country. These are NOT included in our price.
Damage during shipping: If carpet arrives damaged, don't accept delivery. Take photos and contact us immediately. We'll file insurance claim and send replacement.
Warranty: What We Fix For Free
Lifetime warranty covers:

Knot failure or pile shedding beyond normal initial shedding (first 2 months)

Structural defects in weaving

Color bleeding or premature fading (does not cover sun damage)

Separation of carpet backing
NOT covered by warranty:

Normal wear and tear

Damage from improper cleaning (you must follow our care instructions)

Pet damage, stains, burns

Damage from flooding or water exposure

Fading from direct sunlight exposure
-
Damage from furniture legs (use carpet pads)
Warranty claim process:

If covered, you ship carpet to us (we reimburse shipping cost)

Repair typically takes 4-6 weeks

We ship repaired carpet back at our expense
Workshop Tours and Masterclasses
Booking confirmation: Your booking is confirmed only when you receive our email confirmation with booking reference number.
Cancellation policy:

48+ hours before scheduled time: Full refund
-
24-48 hours before: 50% refund
-
Less than 24 hours or no-show: No refund
Rescheduling: Free rescheduling if done 48+ hours in advance, subject to availability.
Our cancellation rights: We may cancel tours due to insufficient bookings (minimum 4 people), emergency, or workshop closure. You'll receive full refund plus ₹1,000 compensation.
Safety and behavior: You must follow our workshop safety rules. We reserve the right to ask disruptive visitors to leave without refund.
Intellectual Property: Who Owns What
Existing designs: Our catalog designs remain our intellectual property. Purchasing a carpet doesn't give you rights to reproduce the design commercially.
Custom designs you commission: You own the rights to designs you paid us to create (₹25,000 design fee). You can reproduce them elsewhere, though we'd prefer you don't.
Designs you provide: If you send us a pattern to replicate, you guarantee you have the legal right to use it. You're responsible for any copyright infringement claims.
Photography: We photograph all our carpets for documentation. We may use these photos on our website, social media, and marketing materials. If you don't want your commissioned carpet photographed publicly, inform us in writing.
What Happens If Things Go Wrong
Limitation of liability: Our total liability to you cannot exceed the amount you paid for the carpet. We are not liable for indirect damages like lost profits or consequential losses.
Force majeure: We're not responsible for delays or failures caused by events beyond our control: natural disasters, war, government restrictions, strikes, material shortages, pandemics, etc.
Disputes and resolution:

Step 1 - Direct communication: Contact us at contact@mirzapurlooms.com. Most issues resolve here.

Step 2 - Formal complaint: Send written complaint to our registered office address. We respond within 14 days with resolution proposal.

Step 3 - Mediation: If unresolved, we agree to attempt mediation through Mirzapur Chamber of Commerce before going to court.

Step 4 - Legal action: Only after mediation fails can either party file lawsuit. Exclusive jurisdiction: Courts in Mirzapur, Uttar Pradesh, India.
Governing law: These terms are governed by Indian Contract Act, 1872 and Consumer Protection Act, 2019.
International customers: You may have additional rights under your local consumer protection laws. These terms don't remove those rights.
